CONDITIONS

1. INTRODUCTION

"ATC" Ltd. Budva, Montenegro (here and after Adriatic-tour.com) is an intermediary between the Client (tourist) and the Host for accommodation in the private apartments.
Provision (or mediation in provision) of other services as: car rent, transfer, sea- cruises, etc. is accomplishing under special contracts and is not a subject of these Conditions.
Adriatic-tour.com is authorized to receive Clients' requests, offer them variants of accommodation, take advance payments and fines and give final confirmation of booking of the accommodation. Requests for booking can be done either electronically or by mail.
By booking, the Client confirm that he has learned and accepted these Conditions. So the present Conditions come into effect as an Agreement between the Client and Adriatic-tour.com as well as between the Host and the Client.

2. BOOKING

Booking is accomplishing on the base of information about accommodation, given to the Client by Adriatic-tour.com (public offer). Prices declared include VAT. In some cases, price can include tourist tax (it must be mentioned in the offer).
Adriatic-tour.com gives final confirmation of booking after the advance payment (30% of the cost of the service, but not less than 35 EUR). The final payment is to be done to the Host directly in cash, on the arrival to the accommodation. If it’s possible to do the final payment to the Host by the credit card, it would be mentioned in the offer. The amount of the advance payment can slightly differ from 30%, according to the accommodation.
In the case of booking later than 7 days before arrival, the Client should pay 100% in advance. To this payment all clauses of p.4 of the present Conditions are applicable. Along with the confirmation of booking the Client receives from Adriatic-tour.com the address and phone number of the Host and instructions how to get the accommodation.

3. OBLIGATIONS

Adriatic-tour.com commits to provide the Client the accommodation in the booked premises. The Host provide the service of accommodation from 12 p.m. the first booking day until 10 p.m. the last booking day.
The Client arrives on his own to the place of accommodation directly and has to accept the service until 12 p.m. the second booking day. If the opposite, the Host has the right to propose this service to the third person. At this moment his obligation to the Client as well as the obligations of Adriatic- tour.com to the Client are considered to be ceased. If the Client for any reason is failing to be in time at the place of accommodation, he has to inform Adriatic-tour.com or the Host about this delay by any possible way. In this case the booking is kept for the Client, under condition of paying for all missed days.

4. ALTERATIONS AND CANCELLATION

Adriatic-tour.com is entitled to change the conditions of booking due to force-majeur (wars, strikes, natural calamities, national emergencies, death of the Host etc.), with informing the Client. The term "changing of booking conditions" means changing of the object of accommodation to the similar or higher category (without raising the cost of booking). If it is impossible to make such changing, Adriatic-tour.com can call off the booking. In this case Adriatic- tour.com pays back the Client the advance payment in full. On the Client request he is provided with the written notification of the force-majeur circumstances have took place according to the rules set by the Civil Law of the Republic of Montenegro.
The Client has the right to change the conditions of booking, such as dates of arrival/departure, number of the guests (if this is important for the specific object of accommodation), object of accommodation itself. In these cases Adriatic- tour.com would do its best to perform these changes without additional fees for the Client. If the conditions of booking offered don't satisfy the Client's needs, the rules of the booking cancellation are to be applied.
The Client has the right to initiate the cancellation of booking. The cancellation must be done in writing (by e- mail, fax, mail). In the case of the cancellation the follows rules of settling are applied:

  • If the notification of cancellation has been received by Adriatic-tour.com not later than 30 days before the date of arrival, advance payment is returned to the Client completely, excepting penalty – 35 EUR and commission charged by bank.
  • If the notification of cancellation has been received by Adriatic-tour.com 15-29 days before the date of arrival, advance payment is not returned to the Client.
  • If the notification of cancellation has been received by Adriatic-tour.com 14-07 days before the date of arrival, advance payment is not returned to the Client. Besides, the Client has to pay the Host 50% of the cost of the service of accommodation (except the advance payment), if the Host has failed to lease the object of accommodation on the booked period to any other person.
  • If the notification of cancellation has been received by Adriatic- tour.com later than 07 days before the date of arrival, or the Client has not arrive to the place of the accommodation in time without notification, advance payment is not returned to the Client. Besides, the Client has to pay the Host 100% of the cost of the service of accommodation (except the advance payment), if the Host has failed to lease the object of accommodation on the booked period to any other person.
  • If the cancellation of booking takes place owing to the circumstances independent of the Client's will (including the death of close relatives), the Client has to present Adriatic-tour.com official papers, confirming such circumstances. The papers must be drawn up in Serbian or English. On the mutual agreement of The Client and Adriatic- tour.com, any other language can be accepted. Adriatic-tour.com has the right to analyse each case of cancellation and propose ways of solving the problem both to the Client and the Host.

Note to p.4:

The Client due to any reason, not mentioned in the present Conditions, can do the advance payment in amount greater than it is necessary for the booking (i.e. if it is needed to receive an entry visa to the Republic of Montenegro). In this case the term "An advance payment" in p.4 of the present Conditions means only the sum needed for booking. On receiving notification of the cancellation of booking, Adriatic- tour.com returns the amount above this sum completely to the Client, excepting commission charged by bank.

5. CLAIMS

All claims connected to non-performance or improper performance of the obligation of Adriatic- tour.com to provide accommodation for the Client (see p.3 of the present Conditions) are to be addressed to Adriatic-tour.com directly and are considered under the terms of p.7 of the present Conditions.
Adriatic-tour.com doesn't bear neither pecuniary no any other responsibility for the quality of the service of accommodation as well as for damaged, destroyed or lost luggage and valuable items at the place of accommodation.
All claims, raising while providing service, the Client is to address to the Host directly. The Client can address to the staff of Adriatic-tour.com in order to have the assistance in dissolving of the problems appeared. In this case Adriatic- tour.com takes all possible efforts to protect the rights of its Clients while providing service.
All payments that could be recovered for improper quality of the service of accommodation must be recovered from the Host.

6. ADDITIONS

The Client has:
- To have the identity card legal for entry to the Republic of Montenegro and staying on its territory.
- To observe the custom, currency and any other Laws of the Republic of Montenegro.
- To observe the rules established at the place of accommodation, including the rules regulating the keeping of cash and valuable items.
In the case the Client has to obtain visa to entry the Republic of Montenegro, Adriatic-tour.com provides him with all papers confirmed the booked accommodation for their submission to Consular office.

7. ISSUE SOLVING

Adriatic-tour.com and the Client (here and after the Parties) would do their best to solve issues on the basis of mutual agreement. If the Parties could not find the compromise, all further issues are to be the subject of the trial in the Main Court of Kotor, Republic of Montenegro.
